Pleural Plaques – House of Lords Judgement
The House of Lords has at last handed down its judgement in the Pleural Plaques test cases and decided that people who are diagnosed with Pleural Plaques – scarring of the lining of the lungs – can indeed no longer claim compensation for the condition. This decision basically approves the earlier decision of the Court of Appeal.
The appeal from the Court of Appeal took place in June this year. The Court of Appeal had overturned over 20 years of case law in January 2006 by deciding that compensation should no longer be paid for Pleural Plaques since the condition does not usually cause symptoms.
