Protect your assets
Can you afford not to?

When divorce or separation becomes reality you will need constant support to see you through the stages of rebuilding your life. At every stage you will be given the expertise, understanding and advice you need to protect you, your children and your assets.

The first reaction is often one of insecurity or anger or even revenge, but you should not give up on each other without full reflection. The approach that the Family Department at Hugh James takes is to urge you to resolve matters amicably and by negotiation if at all possible (sometimes with the assistance of independent counseling). Recourse to litigation is often the last resort. However, if court proceedings are the only answer, then we will do our best to make sure that the break up is handled as sensitively and fairly as possible.

Splitting up can be messy, not only emotionally but also financially. You want to be confident that stress does not take over where common sense should be a priority. There are also the children to think about and their future well being. Kramer v Kramer may have been a memorable film but its plot is not one we would wish you to experience in real life! At Hugh James we aim to minimise trauma at every step and avoid any potential tug-of-war mentality.

Relating to Relationships

Whilst we at Hugh James cannot claim to influence cupid’s arrow we can advise you on the practicalities of settling down with a loved one. Pre-nuptial agreements, although increasingly popular, are not strictly enforceable in the UK. However recent case law has shown that such an agreement is likely to be upheld. If you want to protect your assets in this way we are happy to help you form the right legal agreement.

You may also share the common misconception that having lived with someone for a length of time you are entitled to half their assets in the event of a split. Wrong: you are more room-mate than soul-mate in the eyes of the law and your rights will depend solely on your financial contributions. You may want to think about getting a legal framework in place before you go down the road of sharing a front door key. It’s not the nicest thing to have to deal with in the first blooms of a relationship but it could save a lot of heartache further down the road.

The Value of Expertise

When a dispute crosses international borders a number of complicated factors come into play. We can advise you on the probability of success in taking action in a range of different countries, and our close working relationships with a number of lawyers across the world brings their world closer to you.

Alternatively, when you find yourself in the heat of the media spotlight, dealing with personal relationship issues can be doubly difficult. You may have a public persona but we believe you also have a right to space to deal with your private life. At Hugh James we are experienced in dealing with celebrities and high net worth individuals and deal with the press, managers and PR professionals to ensure reputations are not tainted by relationship difficulties.
