Land Compensation Claims
If the use of a new or altered road, airport or other public works impacts on the enjoyment of your property you may be entitled to compensation for the affect on the value of your property.
The Land Compensation Act 1973 created a new right to compensation for the loss of the value of interests in land caused by use of highways, airports and other public works. The right to compensation arises when the value of an interest in land is depreciated by physical factors such as noise, vibration, smell, smoke, fumes, artificial lighting etc. caused by the use of public works. The Act specifically includes physical factors caused by aircraft arriving or departing from an airport.
Compensation under the Act is assessed by calculating the depreciation on property values caused by the use of the new or extended works. Claims are made against the relevant responsible public authority.
There are time limits for claims and a complex array of statutory provisions which apply and we therefore recommend anyone with a claim to take legal advice.
