The Mogden Sewage Treatment Works were built between 1931 and 1935 in Isleworth. Since 1989 the works have been run by Thames Water Utilities Ltd.

Residents living near the Mogden Works have complained about odours and nuisance from mosquitoes from the Mogden site for several years but from 1999 there was a dramatic escalation in the number of complaints. By July 2001 the situation was so bad that local residents formed the Mogden Residents Action Group (‘MRAG’) to put pressure on the Authority to take action over the problems relating to the Mogden site.

Shortly after the formation of MRAG Hounslow Borough Council served a statutory Abatement Notice on Thames Water in relation to the problem but despite protracted legal action residents continue to suffer.

Sewage smells from the works blight local residents causing a public nuisance. The works have also been identified as a major breeding site for the human biting mosquito Culex pipiens molestus.

In May 2004 Hugh James were approached by the Mogden Residents Action Group to investigate the possibility of bringing a group civil claim against Thames Water Utilities Ltd.

We quickly put together a team of specialists and secured funding from the Legal Services Commission. A group action claim has been issued in the High Court against Thames Water Utilities and in December 2005 Hugh James were appointed by the Court to act as lead solicitors.

We currently act on behalf of over 1300 residents pursuing claims. The case came before Mr Justice Ramsey on key preliminary points of law in March 2007. A Judgment on preliminary issues was handed down in August 2007; click here to read the full Judgment. The case is now ongoing.

Residents are seeking an injunction to prevent Thames from continuing to cause a nuisance and compensation for loss of enjoyment of property and breaches of human rights.
